The Federal Ministry&#8217;s own <a href=\"https:\/\/www.bmbfsfj.bund.de\/bmbfsfj\/themen\/gleichstellung\/frauen-vor-gewalt-schuetzen\/prostituiertenschutzgesetz\/prostituiertenschutzgesetz-fragen-und-antworten\" target=\"_blank\" rel=\"noopener nofollow\">questions and answers on the Act<\/a> give escort arrangements as the example, even where it is open at the outset whether anything sexual will take place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the line runs through conduct. Forward inquiries, fix appointments, select, take a share of the fee\u2014and you are mediating. Publish an advertisement for a flat charge and leave the contact to the parties\u2014and you are publishing. Between the two lies a grey zone the 2017 statute did not anticipate: platforms that verify profiles, deliver messages and sell prominence without ever arranging a date themselves. A <a href=\"https:\/\/www.anwalt.de\/rechtstipps\/sind-anzeigenportale-prostitutionsvermittler-im-sinne-des-prostituiertenschutzgesetzes_119063.html\" target=\"_blank\" rel=\"noopener nofollow\">legal analysis from the Act&#8217;s first year<\/a> concluded that pure listing sites are not mediators, while recording that one state authority read it the other way at the time. No court has settled the point since. The <a href=\"https:\/\/www.bmbfsfj.bund.de\/resource\/blob\/276632\/b9a6eb00836838acf147ef50439c9f93\/zusammenfassung-der-evaluation-zum-prostschg-data.pdf\" target=\"_blank\" rel=\"noopener nofollow\">statutory evaluation published in June 2025<\/a> notes drily that initiation is moving online and recommends that regulation of this area\u2014&#8221;in particular the so-called prostitution platforms&#8221;\u2014be considered. Put plainly: today they sit outside the permit regime.<\/p>\n\n\n\n<h2 id=\"what-a-permit-proves-and-what-it-does-not\" class=\"wp-block-heading\">What a permit proves\u2014and what it does not<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A permit under <a href=\"https:\/\/www.gesetze-im-internet.de\/prostschg\/__12.html\" target=\"_blank\" rel=\"noopener nofollow\">\u00a7 12 ProstSchG<\/a> proves that an authority has examined the operator&#8217;s reliability and approved the operating concept. It does not prove that the photographs are genuine, the selection careful or your data handled discreetly. The two deserve to be kept apart.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What the permit does deliver is concrete enough. Anyone convicted of offences against sexual self-determination or bodily integrity is refused; reliability is re-examined at least every three years. An operator may only let someone work who presents a valid registration or alias certificate together with proof of health counselling, and must keep records of having seen them. And an operator may give no instructions whatsoever on the kind or extent of sexual services\u2014what happens between two adults remains their decision. As hosting services they fall within the European Digital Services Act, applicable since February 2024, which requires a notice-and-action procedure for illegal content and reasoned decisions towards users while forbidding any general obligation to monitor; the duty to identify commercial sellers applies, on the <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/api\/files\/document\/print\/en\/qanda_20_2348\/QANDA_20_2348_EN.pdf\" target=\"_blank\" rel=\"noopener nofollow\">European Commission&#8217;s own account<\/a>, to online marketplaces where contracts are concluded, not automatically to every directory. In practice: at an agency there is a person who reads your complaint and stands behind the introduction. At a platform there is a form. Legislative proposals are due by the end of November 2026, the final report by the end of May 2027. Those are proposals, not changes in the law; what becomes statute is for the Bundestag to decide afterwards. Licensed agencies are unlikely to see much change. The layer in between may see rather more. This article will be updated once the proposals are published.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which leaves the question of what an agency amounts to beyond its permit.
